PrimeGEN Internet Labs ( Division of PrimeGEN Technologies, Inc. Michigan ) provides Internet Consulting including Web Site Designing, Marketing, Hosting and E-Commerce services. PrimeGEN has certain rules and regulations for the use of its services and equipment, to make sure that all of our clients get the quality service as promised at the time of signup.

Important Notice

PrimeGEN reserves the right to cancel and suspend a client's access and
usage of our services and equipment when it(PrimeGEN) decides that the
account has been inappropriately used by the customer, without any prior notice.

The following PrimeGEN regulations apply to all accounts

PrimeGEN Payment Policies

PrimeGEN sets up client's accounts on a pay-at-service basis.

All payment are due in U.S. currency only.

We guarantee the pricing for the term of pre-payment. If a client decides to terminate
the annual pre-paid account, he is still liable for set up charges
and the amount of discount provided upfront for our services.
In such events, account will be billed on pro-rated basis.

PrimeGEN maintains the right to revise prices at any time.

Any outstanding account not brought current within a week of
e-mail notice is subject to suspension, and a late fee of $10.00 per week will also be
charged.

The customer is liable for all money owed on the account from the time it
was established to the time that the customer notifies PrimeGEN in writing for a
request for termination of services.

Setup fees is charged for all new accounts and major account changes. These charges are NON-REFUNDABLE after first 30-day
money back guarantee period is over.

Using TEST DRIVE Plan does require you to submit a valid credit card information.
No charge will be billed during the first 30 days trial period.

By filling out the online order form including the credit card information, the client
expresses consent for PrimeGEN to post the due charges on the card provided.

Using invalid credit card information is a serious crime, and legal actions may be taken
against the defaulter in such an event.

PrimeGEN Do Not Allow Hosting of Adult Oriented Sites

We do not allow adult content of any nature to be hosted on our servers.
PrimeGEN does not allow our services and equipment to be used for the
propagation, distribution, housing, processing, storing of lewd,
obscene  or pornographic material or any other material which we deem to
be objectionable, including, but not limited to pornography, satanic
materials, and any and all materials of an adult nature. The
specification of any materials as such described above is left entirely
to the discretion of PrimeGEN.

CGI Placement Policy

You are allowed to freely install many types of scripts available on the internet, but we reserve the right, without warning to disable any script that may effect normal server operation.

Chat Rooms

We do not allow clients to install their own chat rooms. These tend to be large system hogs and we cannot allow it as an account option. However, we do provide a choice of Java chatrooms for a small extra charge that will more than fill your needs and run without hindering the performance of the machine for others.

IRC, Chat Rooms and Background Running Programs

We currently do not allow IRC or IRC bots to be operated on our servers.
We provide a choice of Java chatrooms for a small extra charge
without hindering the performance of the server machine for others.
We do not allow clients to install their own chat rooms.
Continually running background programs are considered on an individual
basis and an extra charge is applied based on system resources used and
operational maintenance  required.                                           

Terms for Unlimited Traffic and Unlimited Web Space Accounts

Unlimited traffic and storage accounts are not to be used as an offsite
storage area for electronic files. All PrimeGEN client web pages(html)
must be LINKED with files(.GIF, .JPEG) in order to be stored on our
servers. Accounts that contain no html documents and a large number of
unlinked files are liable to be terminated by PrimeGEN. Customers are
not to maintain shareware archives or have large archives of files which
could be downloaded freely by others. A customer violating the above
condition is liable for extra traffic and web space charges. A client
selling his/her space without a reseller package is liable for legal
action and account termination.                                    

PrimeGEN Legal Terms

Customers may use PrimeGEN Services for lawful legal purposes only.
Transmission of any material in violation of any Federal, State or Local
regulation is strongly prohibited. This includes, but is not limited to
copyrighted material, material legally judged to be threatening or
obscene, and material protected by trade secrets. Customers cannot
sublease, subhost, or give away control of any portion of PrimeGEN
resources. Violation will result in immediate account cancellation.
PrimeGEN reserves the right to refuse service to any individual or
entity.

PrimeGEN holds the right to bring legal charges against an individual if he/she
attempts to cause harm to our servers or customers.

Hacking/Unauthorized use of other clients/people's accounts

Any hacking/unauthorized use of accounts or computers by a PrimeGEN
customer(whether or not the
attacked account or computer belongs to PrimeGEN) will result in account
cancellation and civil or criminal legal action, depending upon the
nature of the misuse. The misuse includes but not limited to internet
scamming i.e. tricking people into releasing their passwords,
unauthorized  use of accounts, security hole scanning etc.

PrimeGEN Policy on using E-mail for commercial advertisements

We strongly discourage the use of e-mail for unsolicited advertisements
and violation will lead to account cancellation. "Spamming," or sending
a message to many different off-topic newsgroups, is considered
unethical. Commercial advertisements are unwanted in Usenet discussion
groups and e-mail  mailing lists.
Inappropriate usage will result in $100.00 penalty with or without account suspension. Sending a
message or an advertisement to more than five or six recipients, is
considered spamming unless the individuals have specifically requested
to be added to a mailing list on that topic.
                                        
PrimeGEN Indemnification Policy

Client agree that it shall defend indemnify, save and hold PrimeGEN
Services harmless from any and all demands, liabilities, losses, costs
and claims, including reasonable attorney's fees asserted against
PrimeGEN Services, its agents, its customers, officers and employees,
that may arise or result from any service provided or performed or agreed to be
performed or any product sold by customer, it's agents, employees or assignees.

Customer agrees to defend, indemnify and hold harmless PrimeGEN Services against
liabilities arising out of; (1) any defective products sold to customer
using PrimeGEN Services (2) any  form of injury to person or property
caused by any products sold or otherwise distributed in connection with
PrimeGEN Services (3) any material supplied by customer infringing or
allegedly infringing on the proprietary rights of a third party (4) copyright infringement

PrimeGEN Cancellation Policy

PrimeGEN reserves the right to cancel service of a client at any time without prior notice
at its discretion. All fees paid in advance of cancellation will be charged on a pro-rated basis if PrimeGEN invokes it's right of cancellation of an account.
If cancellation is caused by customers violation of PrimeGEN user policies, then no
refund is due. Any violation of policies which results in extra costs will be billed to
the customer (i.e. transfer, space etc.) Customers have the right to
cancel service any time and will be refunded any amount exceeding the
pre-payment of the current month. Payment will be made by company
check. Due to security concerns, after 30-day initial period, all account cancellations
must be done in writing via US mail with a valid signature of the primary contact of
the account, account name and reason for cancellation.

PrimeGEN Disclaimer Notice

PrimeGEN will not be responsible for any damages your business may
suffer as a result of using our services. PrimeGEN makes no warranties
of any kind, expressed or implied for services we provide. PrimeGEN
disclaims any warranty or merchantability or fitness for a particular
purpose. The includes loss of data resulting from delays, non-deliveries,
wrong delivery, and any and all service interruptions caused by PrimeGEN
and its employees. PrimeGEN reserves the right to revise its policies at
any time.

All PrimeGEN resellers, sub-networks  and dedicated servers of PrimeGEN
must comply to the above policies.

Failure to follow any term or condition will be grounds for instantaneous account cancellation
and may be a cause for legal action. PrimeGEN also reserve the right to remove any account
without any prior notice.

PrimeGEN reserves complete right to revise its policies without any prior notice or announcement.
